N SIVA REDDY(SC FOR APTRANSCO) The Court Made the Following Order:- This Writ Petition under Article 226 of the Constitution of India is filed for the following relief: “to issue an appropriate Writ or order or direction under Article 226 of the Constitution of India particularly one 2 in the nature of writ of MANDAMUS declaring the impugned Memo No SE/O/ATP/P0/Adm/Cl/D No 2976/1415 dt 3.3.2014 by the 4th respondent retiring the petitioner on 31.12.2016 on superannuation at the age of 59 years as illegal arbitrary contrary to Act 4 of 2014 to the extent of amending Section 3 of the A P Public employment Regulation of age of superannuation 1984 dt 27.8.2014 and the order in SLPC No 14699 14702 of 2017 dt 552017 consequently setaside the impugned Memo No SE/0/ATP/P0/Adm/C1/D No 2976/1415 dated 3.3.2014 of the 4th respondent to the extent of retiring the petitioner at the age of 58 years with a direction to the respondents 2 to 4 to reinstate the petitioner into service and allow to continue till the petitioner completed 60 years of age with all consequential benefits and to pass...” 2. Today, when the matter is taken up hearing, Sri Nuthalapati Krishna Murthy, learned counsel for the petitioner would submit that the petitioner’s service was extended up to the age of 60 years, after which he retired from the service. Therefore, the cause in the Writ Petition does not survive for further adjudication and the Writ Petition has become infructuous. 3. Recording the submission made by learned counsel for the petitioner, the Writ Petition is dismissed as infructuous. There shall be no orders as to costs.
