Heard Ms. Indu Sharma, learned counsel for the petitioner and learned AGA for the State. 2. By means of this petition the petitioner has prayed following relief : "(i) Issue a writ, order or direction in the nature of mandamus thereby commanding and directing the opposite parties No. 3 and 4 to conduct a fair and transparent investigation in Crime No. 780/2025, registered under section 105 BNS at Police Station Sushant Golf City, District Lucknow, on 02.09.2025. (ii) Issue a writ, order or direction in the nature of mandamus thereby commanding and directing the opposite parties no.3 and 4 to convert the case from Section 105 BNS to Section 101 BNS (murder) on the basis of the available evidence, including the CCTV footage. (iii) Issue a writ, order or direction in the nature of mandamus thereby commanding and directing the opposite party no.2 i.e. Commissioner of Police, Commissionerate, Lucknow to transfer the investigation of case crime no.780/2025, registered under section 105 BNS at Police Station Sushant Golf City, District Lucknow to another investigating agency for proper and fair investigation." 3. Learned AGA has informed that the investigating team has conducted the investigation properly and relevant material / evidences are being collected. About ten parchas have been prepared. Keeping in a view the aforesaid facts and circumstances we hereby dispose of this petition finally at the admission stage having expectation from the investigating agency to conduct and conclude the investigation strictly in accordance with law and all credible material would be collected and considered and the charge-sheet may be filed under the appropriate sections. 5.
