The petitioner has been made accused in connection with Katkamsandi P.S. Case No. 399 of 2023 corresponding to NDPS Case No.49/2023, for the offences registered under Sections 414/34 of the Indian Penal Code and Sections 17(c), 18(c), 22(c) & 29 of the N.D.P.S. Act, pending in the court of learned Sessions Judge-cum-Special Judge NDPS, Hazaribag. 3. On 14.09.2023, Katkamsandi police apprehended co-accused namely Maksud Khan and Tanjil Alam while travelling on a motorcycle from a place near +2 High School, Katkamsandi. 4. It appears that 60 grams of brown sugar was recovered from the possession of apprehended co-accused persons. 5. It was submitted that though the petitioner is named in the F.I.R. but his name has transpired on confession of apprehended co-accused. It was further submitted that nothing incriminating has been recovered from possession of this petitioner. 6. Learned A.P.P. has opposed the prayer for bail of the petitioner and has submitted that petitioner has got criminal antecedent. 7. Considering the fact that there is no cogent material available against the petitioner, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge-cum-Special Judge NDPS, Hazaribag in connection with Katkamsandi P.S.
