Judgment / Order 17/07/2025 The present third bail application has been filed under Section 483 B.N.S.S. (previously 439 Cr.P.C.). The petitioner has been arrested in connection with FIR No.5/2020 registered at Police Station Pahadi, District Bharatpur for the offence under Sections 147, 148, 149, 323, 341, 302 IPC and Section 25(3) of the Arms Act. Prayer for bail has been renewed on the ground of long incarceration.
Learned counsel for the petitioner submits that he is in custody since 23.01.2020 and looking to the long period of his incarceration, he may be extended benefit of bail. Per contra, learned Public Prosecutor assisted by learned counsel for the complainant submitted that the trial is over and case is fixed on 29.07.2025 for statement of the accused under
[2025:RJ-JP:26677] (2 of 2) [CRLMB-6730/2025] Section 313 Cr.P.C. He, therefore, prays for dismissal of the bail application. Heard. Considered. The petitioner is facing trial, amongst others, under Section 302 IPC. Indisputably, all the prosecution witnesses have already been examined and the case is fixed on 29.07.2025 for statement of accused under Section 313 Cr.P.C. Therefore, evidently, the trial is at his fag end. In view thereof, this Court is not inclined to extend the petitioner benefit of bail on the ground of long incarceration at this stage. The criminal miscellaneous third bail application is dismissed accordingly. However, looking to length of custody of the petitioner, learned trial Court is requested to expedite hearing and conclusion of the case. The Registrar (Judl.) is directed to remit a copy of this order to the jurisdictional Court.
