Heard learned counsel for the petitioner, learned counsel for the State and perused the record. Instant petition has been filed with the following reliefs:- "i. Issue a writ order or direction in the nature of mandamus thereby directing the opposite party No.2 to consider the recommendation send by the Manager/Principal of the college on 07.07.2025 and 23/24.07.20205 on the post of lecturer in History; ii. Issue a writ order or direction in the nature of mandamus thereby directing the opposite party No.2 to pay the salary for the post of lecturer in History since the date of promotion; iii. Issue such other order or orders as this Hon'ble Court may deem just and proper in the circumstances of the case, in favour of the petitioner and against the opposite parties; iv. Award the cost of the writ petition in favour of the petitioner and against the opposite parties." It is contended by learned counsel for the petitioner that the petitioner is the Senior most Assistant Teacher, who joined the institution on 26.12.1999 and while working in the institution, his conduct was above-board. He submitted that a post of Lecturer(History) fell vacant under the 50% promotion quota and the petitioner is fully eligible for promotion and that is why the Manager, Committee of Management including the Principal declined the proposal of promotion of the petitioner. He submits that the said proposal is still pending consideration before the opposite party no. 2. He submits that Versus Counsel for Petitioner(s) : Sanjay Misra, Mrs. Anju Raghuvansh Counsel for Respondent(s) : C.S.C. Ajay Bahadur Singh .....Petitioner(s) State Of U.P. Thru. Secy. Secondary Education Govt. Lko. And Another .....Respondent(s) interest of justice would be sub-served if this Hon'ble Court may be pleased to direct the opposite party no. 2 to consider & decide the proposal dated 07.07.2025 and 23/24.07.2025 appended as annexure nos. 1 and 2 to this writ petition, within stipulated period of time as may be fixed by this Court. Learned counsel appearing for the State has no objection to the contentions aforesaid. Be that as it may, without entering into the merit of the case, the opposite party no. 2 is hereby directed to consider and decide the proposal dated 07.07.2025 and 23/24.07.2025 sent by the institution regarding the recommendation of the promotion of the petitioner within period of three months from the date, a certified copy of this order is produced before him, in accordance with law, if the same is in fact pending before him.
