In CRL.P No. 3150 of 2025: 2. The petitioners are charge sheet for the offences punishable under Sections 341, 504, 149, 448 and 323 of IPC. 3. The prosecution alleges that petitioner No.1- accused No.1 daughter-in-law and other accused are relatives of accused No.1, criminally trespassed into the marital home of accused No.1, abused, assaulted and - 5 - NC: 2025:KHC:10349 CRL.P No. 3150 of 2025 C/W CRL.P No. 3166 of 2025 threatened the informant-respondent No.2 with dire consequences. In CRL.P No. 3166/2025: 4. The petitioners are charge sheet for the offences punishable under Sections 498A, 506, 504, 323 r/w Section 34 of IPC. 5. The prosecution alleges that petitioner No.1- accused No.1 is the husband of, and other accused are relatives of accused No.1, subject the respondent No.2- defacto complainant to cruelty, both mentally and physically, abused, assaulted and threatened her with dire consequences. 6. The petitioners are present before this Court and they have filed a joint memo stating that they have amicably resolved the dispute among themselves and in terms of the settlement, the respondent No.2-wife of accused No 1 in Crl.P.No.3166/2025 has reunited with her husband and leading a cordial marital life and the complainants in these petitions have agreed to withdraw all the allegations made against each others and they have no objections for quashing the impugned proceedings. - 6 - NC: 2025:KHC:10349 CRL.P No. 3150 of 2025 C/W CRL.P No. 3166 of 2025 7. The said joint memo along with a joint affidavit is placed on record. 8. Though the offences alleged are cognizable and non-compoundable, however, having regard to the fact that, the parties have amicably resolved the dispute among themselves, it would be a futile exercise to subject the petitioners-accused to trial, since the probability of their conviction is remote and bleak in view of the settlement. Therefore, the continuation of the Criminal proceedings will be an abuse of the process of law. 9. Accordingly, I pass the following: ORDER i. Criminal petitions are allowed. ii. The impugned proceedings in C.C.19216/2024 (arising out of Crime No.73/2024, registered by the Yeshwanthapura Police Station) pending on the file of the 31St Additional CMM Court, Bangalore city, insofar it relates to the petitioners in Crl.P.No.3150/2025 stands quashed. iii. The impugned proceedings in C.C.No.15563/2023, (arising out of Crime No.225/2023, registered by the Rajanukunte Police Station) pending on the file of the 2nd - 7 - NC: 2025:KHC:10349 CRL.P No. 3150 of 2025 C/W CRL.P No. 3166 of 2025 Additional C.J.M.
