04/ 12.08.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with C. Case No. 575 of 2025, registered under section 47(a)/52(d)/55 of the Excise Act, pending in the Court of learned Judicial Magistrate, Ist Class, Hazaribagh.

Learned counsel for the petitioner submits that allegation is made that 10,835.64 liters foreign liquor was recovered from the Poultry Form of village Daru. He submits that the petitioner has no concern with the said and recovery has been made from the house of one Umesh Sao and nothing has been recovered from the possession of the petitioner. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that criminal antecedent is there against the petitioner.

Considering that petitioner has criminal antecedent and there is allegation of recovery of 10,835.64 liters of foreign liquor of different brands, the name of the petitioner has been disclosed by the villagers that he is accomplish of Umesh Sao and anticipatory bail of the petitioner has been rejected in A.B.A. No. 4318 of 2025, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer of anticipatory bail is hereby rejected.
