CORAM: HON’BLE MR. JUSTICE DEEPAK ROSHAN
--------- For the Petitioner : Mr. Pratik Sen, Advocate For the Opp. Party : Mr. Praful Jojo, A.P.P.
Mr. Anil Kr. Sinha, Advocate
--------- 02/08.08.2025 Heard learned counsels for the parties.
2.
The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 137(2), 87/3(5) of the B.N.S. 2023, in connection with Korrah P.S. Case No.58 of
2025.
3.
Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR and he has been falsely implicated in this regard. Petitioner has no criminal antecedent. He further submits that victim girl was apprehended with one Pradeep Ray and not with the present petitioner and further, she refused to get herself medically examined. He further submits that the allegation made against the petitioner in the FIR is nothing but a concocted piece of story since there is no iota of evidence against petitioner in this case. Further, he submits that the petitioner has been arrested merely on the basis of statement of the informant. He further submits that petitioner is languishing in custody since 30.04.2025; as such, the petitioner may be enlarged on bail. He is ready to abide by every condition imposed by this court.
4.
Learned A.P.P. for the State and learned counsel for the opposite party opposes the prayer for bail of the petitioner.
5.
Having regard to the facts and circumstances of the case, I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is
directed to be released on bail on furnishing bail bond of Rs. 20,000/-
2025:JHHC:22592 2 (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hazaribagh in connection with Korrah P.S. Case No.58 of 2025.
6.
It is made clear that the petitioner shall appear on each and every date before the learned trial court and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
