HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 10536 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant and learned AGA for the State and perused the record. In the prosecution version, it is alleged that four persons were apprehended while transporting eight bulls, purportedly for slaughter in the State of Bihar.
Learned counsel for the applicant contends that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that, even if the prosecution allegations are taken at face value, mere transportation of bulls would not constitute an offence under the Cow Slaughter Act.
Learned counsel for the applicant submits that the co-accused Manoj Yadav who was assigned the similar role has been enlarged on bail by this Court vide order dated 6.11.2025 passed in criminal misc. bail application No. 10345 of 2025. Learned counsel for the applicant seeks parity with the order of the co-accused. He further submits that the other co-accused persons namely Bheem Yadav and Sharma Yadav have also been granted bail by this Court vide orders dated 6.11.2025 and 31.10.2025 passed in Bail Application No.10400 of 2025 and Bail No.10562 of 2025. Versus Counsel for Applicant(s) : Vijay Kumar Yadav Counsel for Opposite Party(s) : G.A. Sagar Yadav .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Home Lko. .....Opposite Party(s)
It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute that it is a case of parity. On due consideration the fact that co-accused Manoj Yadav and other co-accused person named above have been granted bail; the applicant has no criminal antecedents, the offences alleged are triable by a Magistrate, the applicant is in judicial custody since 15.09.2025, and the charge sheet has already been submitted, this Court finds it to be a fit case for granting bail to the applicant on the ground of parity. Accordingly, the bail application is allowed on the ground of parity. Let the applicant involved in Case Crime no.- 187/2025, Under Section:-3/5A/8 U. P. Prevention of Cow Slaughter Act & Section 11 Prevention of Cruelty To Animals Act, Police Station:- Pachpedwa, District:-Balrampur, be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:- (i) The applicant will not tamper with the evidence during the trial.
