Smt. B. V. Vidyulatha, learned counsel for the complainant is appearing through video conferencing seeking - 3 - NC: 2025:KHC:9162-DB CCC No. 303 of 2023 permission of this Court to withdraw this contempt proceeding, with liberty and submits that to that effect she has filed a memo which reads as under: "The complainant seeks leave of this Hon'ble Court to withdraw the present contempt petition and seeks for liberty to challenge the order dated 05.12.2022 issued by the Commissioner for Public Instructions, New Public Officers, Bangalore, which is produced at Annexure-N of this present contempt petition." 3. Ms. Chaithra, representing Smt. B. V. Vidyulatha, learned counsel for the complainant is present before the Court physically. 4. Learned Addl. Government Advocate appearing for respondents/accused is present before the Court physically and submits that the memo along with documents have been furnished wherein similar issues between the complainant and respondents/accused are yet to be considered in WA.No.2476/2015 connected with WA.No.2467/2015. 5. Keeping in view the status in this matter, it is deemed appropriate that the complainant be permitted to withdraw this contempt proceeding in terms of the submission made by learned counsel for the complainant. - 4 - NC: 2025:KHC:9162-DB CCC No. 303 of 2023 6. Keeping in view the submission made by learned counsel for the complainant, the liberty is granted as sought for. 7. Accordingly, the contempt proceeding is hereby dropped. 8. Keeping in view the submission made by learned counsel for the complainant, it is said that there is no consequence to consider the delay application. Hence, I.A.No.1/2023 is hereby disposed of.
