The writ petition has been filed praying for quashing the F.I.R. dated 01.02.2025 giving rise to Case Crime No. 0046 of 2025, under Sections 352, 351(2), 308(5), 318(4), 338, 336(3), 340(2) B.N.S., Police Station- Beta-2, District- Gautam Buddh Nagar. Learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in this case and in case the matter is referred to the Mediation Centre of this Court, dispute between the parties can be settled. Learned counsel for respondent no.4 states that there is no possibility of mediation between the parties. Investigation is going on. Under the totality of facts and circumstances of this case and for the reasons given in the order dated 10.7.2024 passed in Criminal Misc. Writ Petition No.7463 of 2024, this writ petition is disposed of directing that till submission of police report under Section 193(3) B.N.S.S., the respondents are restrained from arresting the petitioners pursuant to the impugned First Information Report, subject to cooperation in ongoing investigation.
