Contempt Case No. 1783 of 2022 has been filed under Sections 10 to 12 of the Contempt of Courts Act to punish the respondents for willful disobedience of the order dated 26.05.2022 passed in l.A.No.1 of 2022 in Writ 4. Petition No. 15368 of 2022. Heard Ms.P.Saraswathi, learned counsel for the petitioners and Sri Dileep Naik, learned Assistant Government Pleader for Revenue appearing for the respondents. Learned counsel for the petitioners, in elaboration to what has been stated in the affidavit, contended that Sri Mohammad Ali, S/o Abdul Jabbar (late), who is the Writ Petition in all the writ petitions got the subject property from his father, who purchased the same under registered sale deed dated 16.09.1953, and till his death on 24.05.1995, his father has been in possession 5. 6. 3 and enjoyment of the subject property. Thereafter, the petitioner and other legal heirs have been in possession and enjoyment of the subject land. When the Forest Department, without following the due procedure prescribed under law, tried to take over the subject land, the petitioner along with his family members approached respondent Nos.2 to 4 along with their title documents and submitted representations dated 13.04.2022 and 16.04.2022 requesting to allow them to carry out their agricultural works and also requesting to give pattadar pass books and title deeds with regard to subject property. Since the respondent authorities have not considered the said representations and again when they tried to interfere with the subject land, the petitioner filed Writ Petition No. 15368 of 2022 and this Court vide order dated 26.05.2022, granted an order of status quo. She further submitted that the petitioner along with other legal heirs made a representation dated 13.06.2022 to respondent No.3- Tahsildar requesting to visit and enquire into the exclusive possession and enjoyment of the subject property and thereby record their possession of the same. However, the same was not considered by respondent No.3. Feeling aggrieved, the other Writ Petition was filed vide Writ Petition No.21156 of 2022. She further submitted that the respondent authorities issued an endorsement dated 16.06.2022, rejecting the petitioner’s claim made in his representation dated 16.04.2022 on the ground that the subject lands claimed by the petitioner are covered in Keelapatia Reserve Forest. Impugning the said endorsement. Writ Petition No.773 of 2023 has been filed. She further I 4 submitted that without verifying the records in a right perspective, the respondent authorities have issued the said endorsement, as such, it is unsustainable. Hence, she prayed to allow the Writ Petitions. She further submitted that since the respondent authorities have willfully disobeyed the orders of this Court dated 26.05.2022 passed in Writ Petition No. 15368 of 2022, the petitioner has been constrained to file Contempt Case No. 1783 of 2022 seeking to initiate proceedings against them under Sections 10 to 12 of the Contempt of Courts Act, 19717. On the other hand, Sri Dileep Naik, learned Assistant Government 7. Pleader for Revenue, while reiterating the contents of the counter affidavits of the District Collector and the Tahsildar, contended that the subject lands mentioned by the petitioners are covered in Keelapatia Reserve Forest, which was notified under Section 15 of A.P. Forest Act vide G.O.Ms.No.501, dated He further submitted that there is no village in the name of 20.12.1985. ‘Anupuvaripalle’ as claimed by the petitioners. In view of the same, the petitioner’s request for grant of pattadar pass books and title deeds was not considered and accordingly, the impugned endorsement was issued. He further contended that in fact, the petitioners earlier made an application invoking the provisions of Estate Abolition Act, for issuance of ‘Ryotwari patta and the same has been rejected by the Settlement Officer on 30.01.1971, but the petitioner has not pursued the said rejection order. Hence, prayed to dismiss the Writ Petitions. 5 In reply, learned counsel for the petitioners submitted that the alleged order of the Settlement Officer mentioned in the counter was not served on the petitioners. Since the petitioner was not served with the rejection order, the same cannot be questioned. She further submitted that extract of A-Register (Register of claims to lands rights to forest produce or easements in the proposed reserve forest Keelapatia extension) reflects the details of the claimants in SI.Nos.5 & 6 showing the village name ‘Mutaka Anupamavaripalle’ and the village of ‘Mutakaanupamavaripalle’ is existing in the government records. She further submitted that the petitioner and other legal heirs are in peaceful possession and enjoyment of the ownership rights since 1953 and due to Carona Pandemic time, they did not enter into the land and taking advantage of the same, respondents entered into their land and threatened to dispossess them from their land. She further submitted that the village in the name of Anupavaripalli’ is habituated village and now it is called as ‘Company Indiu’. Hence, prayed to allow the Writ Petitions. Perused the record and considered the submissions made by both the learned counsel. 8. 9. 10. It is not in dispute that the petitioner made an application invoking the provisions of Estate Abolition Act, 1948 for issuance of Ryotwari patta before the Settlement Officer. It is the contention of the respondents that the Settlement Officer, Nellore vide order, dated 30.01.1971 has rejected the application of the petitioner. X I 6 11. Perusal of the letter addressed by the District Forest Officer to the learned Government Pleader for Revenue vide Rc.No.25/2023/A5, dated 06.01.2023 shows that in the Fair adangal of Keelapatia Revenue village, it is mentioned that the petition of Sri Abdul Jabbar Sahib for grant of patta rejected by the Settlement Officer, Nellore vide his S.R.No.12/1547/70/ PGN dated 30.01.1971. When the petitioner has made an application before the Settlement Officer for issuance of Ryotwari patta way back in the year 1971, he has to pursue with the said authority about the said application. The petitioner is unable to explain the reasons for not pursing with the said authority about his appHcation. In the said circumstances, this Court can easily presume that the Settlement Officer has passed order on the application of the petitioner as stated in the counter. Perusal of the Endorsement of the Collector & District Magistrate, Chittoor vide Roc.L7/e-Office file No.406039/2022 dated 16.06.2022 shows that the Revenue Divisional Officer, Palamaner submitted a report in Roc.A/173/2022 dated 09.06.2022 which was extracted in the endorsement which reads that “there is no notified village in the name of ‘Anupuvaripalle’ h/o Keelapatia Revenue village of Gangavaram Mandal in Chittoor District and per Fair adangal of Keelapatia Revenue village of Gangavaram Mandal, the land in Paimashi No. 108 is classified as Inam-Wet with an extent of Ac.0.70 cents stands registered in the name of Sri Dasabandham Kodipunjula Venkataswamy and Paspula Salama vide T.D.No.1652: land in Paimashi was 12. as I 7 No. 109 is classified as Inam-Wet to an extent of Ac.0.30 cents stands registered in the name of Neerugatti; lands in Paimashi No.107 is classified as Inam-Dry extent of Ac.1.84 cents and the details of Paimashi numbers and its correlated survey numbers as per Fair adangal of Keelapatia Revenue village of Gangavaram Mandal stand in the name of some third parties.” The survey report, Fair adangal and sketch of the subject land were also taken into consideration while issuing the Endorsement, wherein it is clearly stated that the lands in Paimashi Nos. 107, 108 and 109 are located at Keelapatia Revenue village and on ground the petitioner is at Keelapatia Reserve Forest, which is about 8 KM from the above Paimashi numbers. Perusal of the record shows that there is a dispute with regard to identity of the property. The petitioners could not place any materia! on record to substantiate their possession with regard to subject property. When serious disputes exist with respect to both title and possession of the subject property, this Court, in exercise of its jurisdiction under Article 226 of the Constitution of India, cannot adjudicate such disputed questions of fact. The stand taken by the petitioner in his reply affidavit is not helpful to come to a conclusion that the petitioner’s lands are situated out of the purview of Forest area. The petitioner has not made out a case warranting interference of this Court in the Writ Petition Nos. 15368 of 2022 and 773 of 2023 and accordingly the same are liable to be dismissed. 13. I 8 By virtue of Endorsement issued by the District collector vide order dated 16.06.2022, rejecting the claim of the petitioner in Writ Petition No. 15368 of 2022, no further orders are required to be passed in Writ Petition No.21156 of 2022, and accordingly, the same is liable to be dismissed. With regard to Contempt Case is concerned, since the authorities have issued Endorsement, rejecting the claim of the petitioner in Writ Petition No.15368 of 2022, there is no contempt as alleged by the petitioner. Therefore, the Contempt Case is liable to be dismissed. 14. t5. 16. Accordingly, the Writ Petition Nos. 15368 & 21156 of 2022 and 773 of 2023 are dismissed. Consequently, the Contempt Case No. 1783 of 2022 is closed. If the petitioners intend to claim title or possession with regard to subject property, they can approach the competent Civil Court for redressal of their grievance.
