This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 190, 191(2), 109(1), 118(1), 118(2), 126(2), 117(2) of the Bharatiya Nyaya Sanhita, 2023. 3. FIR has been lodged against 5-6 unknown persons on allegation of assaulting the informant and others. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case without any cogent and reliable evidence. 5. Learned A.P.P. representing the State opposes the prayer for anticipatory bail but after going through the case diary he submits that the petitioner has not taken any active part in assault though the others have assaulted because of which the victim sustained injury. Surprisingly the nature of injury has not been mentioned in the injury report as on date and kept reserved. 6. After hearing the parties and going through the case diary and also submission of learned APP it is clear that the petitioner infact had tried to pacify and resolve the dispute and was sitting quietly. 2025:JHHC:20144 2 7. Considering the submission of learned APP that the petitioner tried to pacify the dispute and the fact that the petitioner has not taken active part in the assault, this court finds it is a fit case to grant anticipatory bail to this petitioner with a direction to the petitioner to appear before the Investigating Officer once in every 15 days till completion of investigation. 8. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, East Singhbhum at Jamshedpur, in connection with Sonari P.S. Case No.20 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property.
