Heard learned counsel for the applicant as well as Sri Rao Narendra Singh, learned A.G.A.-I for the State-opposite party no.1. 2. The present application has been filed with a prayer to issue a direction to the Chief Judicial Magistrate, Sitapur to ensure the presence of the accused person in Complaint Case No.1818 of 2023, Smt. Suman Yadav Vs. Bhanu Pratap and others, under Section 379 IPC, and decide the same within a stipulated period. 3. Learned counsel for the applicant submits that the aforesaid complaint case has been pending since 2023 and the accused has not appeared, on account of which the case is not proceeding substantially. He, therefore, prays that a direction may be issued to the court concerned to decide the case as expeditiously as possible. 4. The order-sheet, which has been annexed as Abnnexure-3 to the application, indicates that accused has not appeared and on several dates, the applicant has also sought adjournments. 5. In view of the aforesaid, the applicant is granted liberty to move an application before the court concerned to expedite the Versus Counsel for Applicant(s) : Mohd. Mansoor, Mohammad Danish, Mohd Siddiq Alam Counsel for Opposite Party(s) : G.A. Smt. Suman Yadav .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. And 3 Others .....Opposite Party(s) case and the trial court will take appropriate decision on the said application. 6.
