1 HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 3478 of 2025 1 - Imran Hussain Aka Jainul Aka Jaid S/o Late Aezaz Hussain Aged About 24 Years R/o Junihatri Rani Suryamukhi Devi Ward No. 26, Thana Kotwali, District- Rajnandgaon, Chhattisgarh. ... Applicant versus 1 - The State of Chhattisgarh Through The Station House Officer Police Out Post Chikhli, Police Station- Kotwali, District- Rajnandgaon, Chhattisgarh. ... Respondent(s) Order on Board 05/05/2025 Shri Hemant Kumar Agrawal, Advocate for the Applicant. Shri Neeraj Sharma, Dy. AG for the State. This is second bail application of the applicant. The first bail application of the applicant was dismissed on merit vide order dated 12.12.2024 passed in MCrC No.8268 of 2024. Learned counsel for the applicant would submit that though the witnesses have been examined prior to 12.12.2024, but considering the nature of allegation against the present applicant and also that the witnesses have not 2 supported their case against the applicant who is in jail since 04.06.2024, there is no seizure from the applicant and there is delay in conclusion of trial, he has filed this second bail application and therefore he may be enlarged on bail. On the other hand the counsel for the State opposes the bail application, however, he submits that out of 38 witnesses, 12 witnesses have already been examined till date. Considering the submissions made by the counsel for the parties, the fact that first bail application was dismissed on merit on 12.12.2024 and prior to that four witnesses have already been examined on whose strength the applicant is claiming bail, I do not find any change in circumstances to grant bail to the applicant. Accordingly, the second bail application is dismissed at motion stage itself. Sd/- (Ravindra Kumar Agrawal) Judge Inder
