By means of this present C528 application, the applicant has challenged the entire proceedings of Criminal Case No.1541 of 2024 (9730/19), State vs. Amit Bhatia, under Section 420 IPC, pending in the court of learned Judicial Magistrate-1st, Haridwar. 4. After arguing for a long, learned counsel for the applicant submits that applicant may be permitted to surrender before the court concerned within fifteen days; however, his bail application may be directed to be decided. 5. He also placed reliance upon the authority of Apex Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation and Another, reported in (2021) 10 SCC 773. For the sake of convenience, relevant portion thereof is quoted hereinbelow:- 3.Category A(e) Bail applications of such accused on appearance may be decided without the accused being taken in physical custody or by granting interim bail till the bail application is decided. 6. In such view of the matter, present C528 application is disposed of permitting the applicant to surrender before the concerned court on or before 03.03.2025; if on surrender any bail application is moved on his behalf, the court concerned is directed to decide the same in view of dictum of the Apex Court in the case of Satender Kumar Antil (Supra). 7.
