For Petitioners : Mr.R.Anbalagan For Respondents : Notice dispensed with ***** ORDER This Writ Petition has been filed by the petitioners seeking for a Writ of Mandamus, to direct the 2nd respondent to return the petitioners pledged jewels, (i) Mala (without doller) having weight of 87.90 Gram on 06.04.2024 under Loan Account No.8358300000027025 and (ii) Plain Bangle having weight of 23.90 Gram and Chain or Mala (without doller) having weight of 35.90 Gram totalling 58.80 Gram on 19.08.2024 under Loan Account No.8358300000036166 in the custody of the 2nd respondent's bank as per the petitioners representation dated 19.09.2025. 2. Since no adverse order is being passed against the respondents, notice to the respondents is dispensed with. 3. The case of the petitioners is that the 1st petitioner married one Raja and out of their wedlock, the petitioners 2 and 3 were born. Thereafter, he died on 27.09.2024 and the petitioners have repaid the said loan, however, they were not able to get no objection from the 3rd respondent, who is the mother-in-law of the 1st petitioner. Hence, they have made a representation before the respondents 1 and 2 dated 19.09.2025 seeking return of jewels. Since the same was not considered, the petitioners have filed this writ petition before this Court for appropriate orders. 4. Though very many grounds have been raised in this writ petition, learned counsel appearing for the petitioners submits that, it would suffice, if this Court issues a direction to the 2nd respondent to return the pledged jewels to the petitioners by considering their representation dated 19.09.2025, within a time frame that may be fixed by this Court. 5. In view of the limited request sought for by the learned counsel appearing for the petitioners, this Court, without expressing any opinion on the merits of the case, directs the 2nd respondent to return the jewels to the petitioners, if they have paid the entire loan amount, within a period Page No.3 of 7 https://www.mhc.tn.gov.in/judis W.P.No.40619 of 2025 of two (2) weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the petitioners and aggrieved persons, if any. 6.
