HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 14780 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J. Heard learned counsel for petitioner and learned state counsel for opposite parties. Petition has been filed seeking following prayer:- "i. to issue a writ, order or direction in the nature of mandamus thereby commanding the respondent authorities to consider the claim of the petitioner for coverage/entitlement under the Old Pension Scheme, on the basis of his initial appointment dated 23.02.1996." At the very outset, Mr. Subodh Kumar Gupta learned state counsel has raised a preliminary objection regarding entertaintainability of this petition in view of the fact that the petitioner is seeking entitlement under the Old Pension Scheme whereas he is still in service. Learned counsel for petitioner does not dispute the fact that he is still in service but submits that since petitioner has been regularized only in the year 2015, he may not be included in the Old Pension Scheme while counting services rendered by him on the initial date of engagement on February 23, 1996. Upon consideration of submissions advanced, it being evident that petitioner is still in service, the petition is found to be premature. Liberty however is granted to petitioner to approach this court again only once he attains superannuation and the aforesaid benefit is not provided.
