Heard learned counsel for applicant, learned A.G.A. and perused the record 2. This application has been filed for issuance of a direction to the Sub Divisional Magistrate, Patti, District Pratapgarh, opposite party no. 2, to expedite the disposal of Case No. 10225/2025 (Computerized Case No. T202402570410225), under Section 133 CrPC, P.S. Patti, District Pratapgarh. 3. Learned counsel for the applicant submits that despite his appearance the case is not being heard and general dates are being fixed on one ground or the other. Learned counsel for the applicant also submits that as per the provisions of Section 309 Cr.P.C., it is obligatory on the part of the court below to conclude the proceedings and no adjournment shall be granted at the request of a party, except where the circumstances are beyond the control of that party. Submission of the learned counsel for the applicant is that since the matter is trivial in nature and is at the stage of filing objections by the respondents, the court below may be directed to expedite the proceeding of the aforesaid case. 4. Learned A.G.A. has no objection to the prayer for expeditious disposal of the aforesaid case. 5. In view of above, the court concerned is directed to decide Case No. 10225/2025 (Computerized Case No. T202402570410225), under Section 133 CrPC, P.S. Patti, District Pratapgarh, expeditiously preferably within a period of six months from the date of production of certified copy of this order after affording opportunity of hearing to all the parties, strictly in accordance with law. 6.
