Neutral Citation No. - 2025:AHC:40251 Court No. - 6 Case :- WRIT - A No. - 3107 of 2025 Petitioner :- Biresh Pratap Singh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Vinay Kumar Srivastava Counsel for Respondent :- C.S.C. Hon'ble Saurabh Shyam Shamshery,J. 1.Heard Sri Vinay Kumar Srivastava, learned counsel for the petitioner and Sri S.P.Singh, learned Additional Chief Standing Counsel.
2. It is not under dispute that father of petitioner retired in the year 2013 and his pension was fixed in the year 2016, however, he died in the year 2017 and thereafter family pension was paid to the petitioner's mother who unfortunately died in the year 2019 and now the petitioner aged about 54 years has approached this Court in the year 2025 that arrears of salary of his deceased father be paid to him.
3. It has not been declared that petitioner was dependent on his father or mother. If arrears of salary was not sought by his father or mother when they were alive, how petitioner is entitled for the same at this stage is also remained unexplained.
4. Learned learned Additional Chief Standing Counsel submits that petitioner has no locus to claim arrears of salary of his deceased father since his father or mother has not taken any step in this regard during their lifetime.
5. Petitioner is not dependent on his father or mother since he has declared that he is doing a private work, therefore, he has no locus to claim arrears of salary of his deceased father as well as he has approached this Court at a very belated stage, therefore, writ petition has no force.
6. Writ Petition is accordingly dismissed. Order Date :- 20.3.2025 SB Digitally signed by :- SANDEEP BHATTACHARYA High Court of Judicature at Allahabad
