HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 10891 of 2022 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. Learned counsel for the applicant submits that the applicant has no criminal antecedents and is in custody since 10.06.2022. It is argued that he has been falsely implicated. There is no independent witness to the incident, as the certificate under Section 65(b) of the Evidence Act has not been obtained by the prosecuting agency. PW-1 and PW-2 have already been examined before the trial court. It is further submitted that there is no likelihood of the applicant tampering with the evidence. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. Considering that the applicant, who has no criminal antecedents, is in jail since 10.06.2022; only two prosecution witnesses have been examined till date; and in view of the judgment of the Hon’ble Supreme Court in Javed Gulam Nabi Shaikh v. State of Maharashtra, 2024 SCC OnLine SC 1693, this Court finds it a fit case for granting bail to the applicant.
