ORDER :
The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1 and 2, for granting of pre-arrest bail in connection with Crime No.44 of 2025 of Singanamala Police Station, Ananthapuramau, registered for the alleged offence punishable under Section 118 (1) read with 3(5) of Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’).
2. Heard Sri Y.Subba Rao, learned counsel for the petitioners and Ms. K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing on behalf of the State.

The brief facts of the prosecution case are that on 18.04.2025 at about 07:30 P.M., at Ullikallu village, Singanamala Mandal, A1–Ajjiguttu Ashok Kumar Reddy, A2–Ajjiguttu Meena @ Anitha, A3–Ajjiguttu Adinarayana Reddy and A4–Ajjiguttu Sankar Reddy, in furtherance of their common intention, voluntarily caused hurt to the complainant M. Renuka, W/o M. Krishna Reddy, Ullikallu village, Singanamala Mandal, by beating her with sticks and caused bleeding and grievous injuries due to a petty quarrel that arose between them. Basing on the complaint, the case was registered and investigated into. During the course of investigation, the police examined LWs.1 to 4 and, after obtaining the wound certificate of the injured from the

Medical Officer, as per which the injuries were certified as grievous in nature, the section of law was altered to Section 118(2) read with 3(5) BNS.

Learned counsel for the petitioner would submit that the petitioners are innocent and have not committed any offence and that they have been falsely implicated in this case. They are law-abiding citizens and have a fixed place of abode. They are ready to abide by any conditions imposed by this Court. It is further submitted that there are no specific overt acts attributed to the petitioners and that there has been a long-standing civil dispute between the de-facto complainant and the accused persons and it is urged to enlarge the petitioners on pre-arrest bail. It is further brought to the notice of this Court that this is a second anticipatory bail application filed by the petitioners, and the earlier application was dismissed with respect to the petitioners by a Coordinate Bench of this Court vide order dated 12.12.2025 in Crl.P.No.11872 of 2025. 5. Learned Assistant Public Prosecutor vehemently opposed the petition and submitted that the petitioners are involved in the commission of a grave offence and that there are specific allegations against them. She would further submit that this is the second anticipatory bail application filed by the petitioners and that the earlier application was dismissed by a Coordinate Bench of this Court. It is further submitted that there is no change in circumstances from the date of dismissal of the earlier application. She finally prays for dismissal of the petition. 5

Considering the submissions made and on perusal of the material on record, and in view of the nature and gravity of the offence alleged against the petitioners, the stage of the investigation, and the fact that there are no change of circumstances from the date of dismissal of the earlier bail application, this Court is not inclined to grant anticipatory bail to the petitioners at this stage. Hence, the petition is liable to be dismissed. 7. At this juncture, learned counsel for the petitioners would submit that liberty may be granted to the petitioners to surrender before the concerned jurisdictional Court and to move an appropriate application. 8. Accordingly, the Criminal Petition is dismissed. However, the petitioners are at liberty to surrender before the learned Jurisdictional Court concerned and move an appropriate application before the learned Jurisdictional Court concerned.
The learned Jurisdictional Court concerned is directed to dispose of the said application in accordance with law, on its own merits by giving due and sufficient opportunity to the learned Public Prosecutor concerned, and pass appropriate orders as expeditiously as possible. As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed. ___________________________________
