Also heard Mr. K. K. Das , learned Addl. Public Prosecutor for the State. Page No.# 2/3 By this application, the petitioner has sought for bail in connection with Baihata Chariali P.S Case No. 197/2025 registered under Section 331(4)/305) of BNS, 2023. The FIR dated 31.07.2025 reveals that some miscreants entered the house of the informant for committing theft and had stolen large amounts of cash from the house of the informant. Mr. B. Chowdhury, learned counsel appearing for the petitioner submits that the only allegation against the petitioner is that his vehicle is used in the commission of the said offence and that one of the accused persons is known to the petitioner and that he had taken his vehicle for taking his family members somewhere. As such, he prays for bail. Mr. K. K. Das , learned Addl. Public Prosecutor however, submits that there are materials in the case diary showing that the petitioner is also involved in the offence and that not only his vehicle is used but also he gets a share in the said offence and is a part of the group committing theft in the house of the informant and others. However, on 25.09.2025 the petitioner was enlarged on pre arrest bail and in compliance with one of the directions given in the said bail order, the petitioner had gone and appeared before the Investigating Officer and his statement was recorded. As such, it is seen that the petitioner is corporating with the investigation of the instant case. Page No.# 3/3 As such, this Court finds it fit that the interim order dated 25.09.2025 may be made absolute with the further condition that the petitioner will abide by the condition already given in the interim bail order dated 25.09.2025. It is further submitted by the learned counsel appearing for the petitioner that the petitioner stands arrested in connection with another case and that he is behind the bars and as such, it is directed that he may corporate with the investigation of the present case and would appear before the Investigating officer as and when called for on attaining freedom.
