ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA 2 2. The present writ petition has been filed by the petitioner with the following prayers: “10.1. That, this hon'ble court may kindly be direct respondents police and Branch Manager of ICICI Bank to release the saving account no. 0161015094896 of ICICI branch Civil Line Branch Raipur which is the account of petitioner as the account has been freezed in pursuance of FIR no. 25/2025 registered in Police Station Chaibasa Mufasil District - West Singham, Jharkhand. 10.2 this Hon'ble Court may kindly be pleased to direct the respondents authorities for fair and further investigation in the case. 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.” 3. Learned counsel for the petitioner submits that the present petition has been filed for releasing the Saving Account of the petitioner, which has been freezed in pursuance of FIR no. 25/2025 registered in Police Station Chaibasa Mufasil District - West Singham, Jharkhand. He further submits that the aforesaid FIR has been lodged on 19.02.2025 by the complainant Parshuram, Vice Chancellor of the Tata College, Kolhan, wherein it is alleged that some unknown person has withdrawn amount of Rs. 6747800/- and 9149300/- from bank account of Punjab National Bank and when the college administration came to know about the 3 above transaction they found that some person has misused the cheque no. 58585 and 58587 and credited the above amount in firm of Radha Rani Enterprises and Shanu Chinta Infra Private Limited and it is alleged that thereafter they transferred about Rs.61 laks on the account of Mitra Enterprises and he transferred some amount in account of present petitioner. Thereafter, the police has informed concerning Bank and they have freezed the account of the present petition and it is shown that the present petitioner is also involved in coming of above offence. He also submits that the petitioner is a small businessman and he has frequent transaction with Mitra Enterprises, therefore, it cannot be said that he is involved in committing of above offence and prior to freezing of his account, the Bank has not intimated the petitioner to take any stand 4. On the other hand, learned State Counsel opposed the aforesaid submission and states that no material has been produced by the petitioner which shows that the freezing of his account has been in pursuance of the aforesaid FIR. 5. We have heard learned counsel for the parties and perused materials available on record. 6. Considering the prayers and pleadings made in the writ petition, particularly the prayer for a direction to release the saving account, which has been freezed by the Bank, we do not find any good ground for interference in the matter. 4 7. Accordingly, the instant petition is dismissed. However, the petitioner is at liberty to move an application under Section 451 of CrPC (Now Section 497 of BNSS, 2023) before the jurisdictional Magistrate, who may call for the report and pass an appropriate order.
