GP FOR MUNCIPAL ADMN URBAN DEV The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.12513 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….to declaring the action of the 3rd and 4th respondents in not preparing the seniority list for the post of Secondary Grade Teacher in 4th respondent municipality in accordance with Rule 33 (b) of State and Subordinate Service Rules 1996 vide proceedings dt.46.2.2018 by placing the unofficial respondents over and above the petitioner herein though they secured less marks in the written test conducted in the year 1994 as illegal and void and opposed to Article 14, 19, 21 of Constitution of India and consequently set aside the same in respect of the unofficial respondents are concerned and direct the respondents 3 and 4 to prepare the seniority list in accordance with Rule 33 (b) of State and Subordinate Service Rules 1996 by placing the petitioner's name at appropriate place over and above the unofficial respondents in accordance with merit i.e., marks secured in the written test by giving promotion to the petitioner as School Assistant (Social Studies) and to pass…” 2. Heard learned counsel for the petitioner. 3. Learned Government Pleader for Municipal Administration and Urban Development on written instructions would submit that basing on the G.O.Ms.No.84, dated 24.06.2022 of Municipal Administration and Urban Development (D-I) Department, Government transferred supervision and administrative responsibilities of Municipal Schools 4 including service matters of the Municipal Teachers to the School Education Department. 4. Learned counsel for the petitioner would submit that the petitioner is not coming forward to prosecute the writ petition. 5. Considering the above facts and circumstances, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs.
