HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 1172 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant and learned A.G.A. for the State. At the outset, a preliminary objection has been raised by the learned A.G.A. that it is not a case of false implication. With a view to usurp land in gata No.499 belonging to his uncle, the applicant has prepared a forged sale deed and showed himself as purchaser and Mishri Lal has been shown as seller. Thereafter, while hatching conspiracy with office bearers of the Sub Registrar office in Gonda, the original sale deed has been substituted with forged one and thereafter, mutation has been done in the name of the applicant. It is submitted that SIT has conducted investigation in this matter. Dozens of first information reports have been lodged. Several original registered sale deeds have been misplaced from the office of the Sub Registrar, Gonda Versus Counsel for Applicant(s) : Rishi Raj Mishra, Sachin Kumar Mishra Counsel for Opposite Party(s) : G.A. Dineshh Kumar Gupta .....Applicant(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And Another .....Opposite Party(s) and have been substituted by the forged one. It cannot be said that it is a case of false implication. The S.I.T. is still investigating this matter. I have considered the submission and perused the record as well as the rejection order. This court finds that the S.I.T. is still investigating the matter and considering the large scale forgery committed in connected matters, prima facie, it cannot be said that it is a case of false implication, or the accused applicant has been implicated only to injure his reputation. No case for anticipatory bail is made out. The anticipatory bail application filed in case crime No.19 of 2023 under sections 419, 420, 467, 468, 471, 120-B, 204 I.P.C., 7A P.C. Act, P.S. SIT, district Lucknow, is dismissed. October 17, 2025 kkb/ ABAIL No. 1172 of 2025 2 (Karunesh Singh Pawar,J.)
