2025:JHHC:20359 IN THE HIGH COURT OF JHARKHAND AT RANCHI Criminal Revision No.709 of 2025 ----- Sandeep Prasad Yadav @ Sandeep Kumar @ Sandeep Kumar Yadav, son of late Jitendra Prasad Yadav, resident of village Basodih, PO Basodih, PS Satgawan, District Koderma .... Petitioner(s). Versus 1.The State of Jharkhand 2.Sushma Devi, wife of Sandeep Prasad Yadav, d/o Kangresh Prasad Yadav, resident of village Basodih, PO Basodih, PS Satgawan, District Koderma, R/o village Barwadih, PO Sankh, PS Tisari, District Giridih … Opp. Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Gautam Kumar, Advocate For the State : Mr. Shiv Shankar Kumar, AddI. P.P. …...... 02/ 24.07.2025: By invoking a criminal jurisdiction of this Court, the petitioner has challenged the order dated 25.04.2025, passed in Original Maintenance Case No.61 of 2024, whereby maintenance has been fixed to the tune of Rs.5,000/- per month in favour of the wife. 2. Heard, the parties at length. 3. After hearing the parties, I find that the marriage between the parties is not denied. Further, there is factual finding arrived at by the Court that the petitioner has neglected the wife. Once these two facts have been established, the petitioner is bound to pay maintenance to the wife. 4. The amount which has been fixed is Rs.5,000/- per month. In these types of cases, Rs.5,000/- maintenance is not exorbitant. In these days, it is a bare minimum amount for maintenance. This quantum fixed is justified. Thus, I find no illegality committed by the Court, either in fixing the quantum or on the merit of this case. 5. With the aforesaid observation, the instant criminal revision stands dismissed.
