Petitioner has approached this Court as he did not receive any response in respect of the informations furnished with the Office of the Commissioner of Police, Kolkata on 30th of March, 2025 and on 8th of April, 2025. Petitioner intends to organise a Shobhayatra from College Street, Bata, Hanuman Mandir to Hari Ghosh Street, Hanuman Mandir with 200 to 250 individuals on 12.04.2025. The said procession would commence from College Street, Bata, Hanuman Mandir at about 05.00 P.M. and the same as represented by the learned advocate appearing on behalf of the petitioner would conclude at Hari Ghosh Street, Hanuman Mandir on 12.04.2025 at about 08.00 P.M.
2 Learned advocate appearing on behalf of the State has raised no objection in respect of the route concerned but has forwarded certain conditions: (a) At any point of time, the total number of participants shall not exceed a number of about 250 individuals. (b) The organizers shall nominate 10 persons from amongst themselves who shall be held responsible for conducting the procession. (c) Only four vehicles and four motorbikes with helmets shall be permitted in the said procession. (d) The participants shall not carry or brandish any arms or weapons. The participants shall not carry in the procession any stick, lathi, weapon. However, they would be allowed to carry flags and/or any other symbolic weapons which should be only made of PVC. In case any weapon made of metal is found, Police would be at liberty to seize the same. (g) The participants shall also abide by relevant pollution norms including sound norms. Only normal sound system i.e. 5/6 microphones be allowed to be used in the procession. No Disc. Jockey should be permitted in the procession. 3 (h) The participants in the procession shall not halt or pause at any place and would continue to gradually proceed towards their final destination. (i) The procession would proceed in a manner from one side of the road so that the plying of the vehicles are not completely stalled.
