3. Secretary (Admn.), Rajasthan Rajya Vidyut Prasaran Nigam Ltd., Vidyut Bhawan, Jyoti Nagar, Jaipur
4. Executive Engineer (220 Kv Gss) Rrvpnl, Dholpur ----Respondents For Petitioner(s) : Mr. M.I. Abbassi For Respondent(s) :
HON'BLE MR. JUSTICE SUDESH BANSAL Order 23/05/2025
1. By means of filing instant writ petition, petitioner has invoked the writ jurisdiction of High Court under Article 226 of the Constitution of India, in order to assail his two transfer orders of even dated 09.05.2025. 2. Initially, vide Order No. 214 dated 09.05.2025, petitioner as Assistant Engineer was transferred from AEN 132 KV GSS Rajakhera, District Dholpur to AEN 400 KV GSS, Bikaner, but on the same date vide Order No. 220 dated 09.05.2025, petitioner has been transferred to AEN 220 KV GSS Badnu, Bikaner. [2025:RJ-JP:21769] (2 of 2) [CW-7995/2025]
3. Having heard counsel for petitioner and from perusal of record, it has emerged as an admitted fact that petitioner was posted as Assistant Engineer at AEN 132 KV GSS Rajakhera on 25.05.2018 and since then, he is continuously serving at that place. Counsel for petitioner sought to assail the transfer order on the ground of distance that he has been transferred near about 950 KM away and his family circumstances do not permit him to render service at such distant place. 4. This Court is of the considered opinion that the transfer order of petitioner has not been challenged on the ground of malafides or in violation to statutory rules or transfer policy of the Government. Obviously, the transfer order has been issued for administrative exigencies. 5. The Apex Court in case of Union of India Vs. Deepak Niranjan Nath Pandit [(2020) 3 SCC 404], has held that interference with transfer order is in excess of jurisdiction and improper exercise of judicial power, when there is no mala fide nor any breach of law in passing the transfer order. 6.
Therefore, this Court, in exercise of its writ jurisdiction, is not inclined to interfere with the transfer order and the writ petition is hereby dismissed. 7. Stay application and other pending application(s), if any, stand disposed of. (SUDESH BANSAL),J NITIN /8
