IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA
CWP No.9021 of 2024
Date of Decision:- 27.03.2025
Sheetal Model Public School & Anr. ....Petitioners. Versus H.P. School Education Board, Dharamshala ....Respondent. Coram
The Hon’ble Mr. Justice Tarlok Singh Chauhan, Judge. The Hon’ble Mr. Justice Sushil Kukreja, Judge.
Whether approved for reporting?1 No. For the Petitioners : Mr. Devender Kumar Sharma, Advocate.
For the Respondent : Ms. Neelam Kaplas, Advocate. Tarlok Singh Chauhan, Judge
(Oral).
On 18.03.2025, the Court passed the following
order:-
“The petitioners are aggrieved by notification dated 21.08.2024, whereby the examination center of the petitioner has been suspended/abolished with immediate effect for the next one year on the ground of serious irregularities reported by the committee constituted to monitor the recording of CCTV cameras pertaining to the examination held in March, 2024. The petitioners would claim that no irregularity was committed during the examination, muchless as 1 Whether reporters of Local Papers may be allowed to see the judgment?
2 pointed out, by the committee. The respondents have filed reply, wherein they have annexed the copy of report of the committee that had been constituted for monitoring the recording of CCTV footage of the examination held in March, 2024 at the petitioner’s school.
Learned counsel for the petitioners seriously disputes the correctness and veracity of such report and would heavily rely upon two pen-drives, appended with the petition as Annexure P-13, to claim that no irregularities can be seen in the CCTV footage as contained in the pen-drives. Having heard the learned counsel for the petitioners, we are of the considered view that a technical team is required to examine the pen-drives so as to tally its contents with the report (Annexure R-9) submitted by the respondents (Annexure R-9) and thereafter submits its report to this Court. Accordingly, a committee comprising of Ms. Divya Bansal, Programmer and Mr. Kuldeep Kumar, Developer, from the Computer Branch of this Registry, is constituted to verify the contents of CCTV footage as contained in the pen-drives and tally the same with the report (Annexure R-9). The said committee shall submit its report in a sealed cover to this Court within a period of one week from today. List on 27.03.2025”. 2. The report of the Technical Committee, in terms of the order passed by this Court on 18.03.2025, is opened in the Court in the presence of the parties. 3. The Committee has verified the contents of the CCTV footage and tallied it with the report (Annexure R-9). The Committee has also verified the contents of the pen-drives with the CCTV footage, so submitted by the petitioner. 3
4. Obviously, in such circumstances, no fault can be found with the action of the respondent, whereby the examination centre of the petitioner has been abolished. 5. We also need to look into the order passed on 18.03.2025 by this Court, regarding the constitution of the committee and given the fact that the respondent had already submitted the report of recording of the CCTV footage (Annexure R-9) and there is no reason for the Court to discuss such report. These were the petitioners, who repeatedly impressed upon this Court to constitute a committee, as according to them, no irregularity was reported by the Committee in its report (Annexure R-9) while monitoring the CCTV footage. 6. Now the technical committee has submitted its report and affirmed the correctness and veracity of the report submitted by the respondent (Annexure R-9). 7. In such circumstances, we are constrained to dismiss the petition with costs which are quantified at Rs.1,00,000/- (Rs. One Lakh), out of which Rs.80,000/- (Rs.
Eighty Thousand) shall go to the Himachal Pradesh High Court Advocates Welfare Fund while the remaining amount of Rs.20,000/- (Rs. Twenty Thousand) shall be
4 paid equally to the members of the technical committee, appointed by this Court. 8. The said costs be deposited in the account(s) of the Himachal Pradesh High Court Advocates Welfare Fund and members of the technical committee constituted by this Court within a period of four weeks. 9. Pending application(s), if any, shall also stand
disposed of.
10. List for compliance on 24.04.2025. (Tarlok Singh Chauhan)
