The petitioners are arraigned as accused Nos.1 and 2 in Cr.No.169 of 2024 on the file of the Srikalahasti II Town, Tirupati District. The said crime was registered for the offences under Sections 329(4), 118(1), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. Learned counsel for the petitioners and learned Assistant Public Prosecutor states that the offences are punishable with seven (07) years or less than seven (07) years. 3. In that view of the matter, the present Criminal Petition is disposed of at the stage of admission directing the concerned police to follow the procedure prescribed under Section 35(3) of the BNSS, 2023 as well as jnthe guidelines enunciated in Arnesh Kumar vs. State of Bihar1.
