HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 12186 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J.
HON'BLE MANJIVE SHUKLA, J.
1. Heard learned counsel appearing on behalf of the parties.
2. This is a writ petition under Article 226 of the Constitution of India, wherein the petitioner is aggrieved by an order of rejection passed by respondent No.3, wherein the application for the petitioner to organize an annual Mela at spiritual place situated at Kurmin Kheda, Post - Utrawan, Police Station- Nigohan, Tehsil- Mohanlalganj, District- Lucknow has been rejected by the authority.
3. Upon perusal of the documents and after hearing learned counsel appearing on behalf of both the parties, it appears that in the year 2024 when the Mela had taken place, there had been an incident of electrocution in the vicinity of the Mela, which had resulted in one death. In light of the same, the permission for holding of the Mela has been rejected.
4. We are of the view that a single such incident should not be the sole reason for rejecting the organization of an annual Mela that has been going on for more than 40 years.
5. In light of the same, we direct respondent No.3 to revisit the issue once again immediately and take a fresh decision on the same today itself. Versus Counsel for Petitioner(s) : Ajeet Verma Counsel for Respondent(s) : C.S.C. Jay Bade Baba Mela Committee Thru.President Mr.Ram Prakash .....Petitioner(s) State Of U.P. Thru. Its Prin. Secy. Home Deptt. Lko. And 4 Others .....Respondent(s)
6. In the event respondent No.3 is of the view that further management and security measures are required, he should provide the same on the date of the annual Mela.

8. With the above directions, the writ petition is disposed of. December 12, 2025 Ashutosh WRIC No. 12186 of 2025 2 (Manjive Shukla,J.) (Shekhar B. Saraf,J.)
