the offences punishable under sections 318(4), 336(3) and 340(2) read with 3(5) of the BNS. 2.
Case of the Prosecution, in brief, iS that On 28.04.2025, the defacto compla-lnant filed a report before the police alleging that he inherited land to an extent of Ac.27.56 cents in Survey No.191 of Rajanagaram Mandal, Namavaram V-lllage from his ancestors-, that out of the said extent, Ac.7.56 cents Of land Was Subd-lVided for construction of a hospital and the land was leveled with gravel and' a room was constructed; that the accused conspired together to acquire Ac.5.00 cents of land, fraudulently Procured Stamp Papers with old dates and alleged to have forged the s'lgnature of the de facfo complainant and brought into existence a Purchase Agreement, dated 01.01.2024; that on ll.03.2025, a notice Was got issued to the cJe fac£o comPlainant Stating that the de faCfo complainant was alleged to have executed an Agreement at the rate of Rs.75.00 lakhs and a Sum Of Rs.60.00 lakhs was given towards advance. 3. ` Heard learned COunSel for the Petitioners and the learned counsel for the respondent No.2. Perused the record. 4. A perusal Of material On record goes tO Show that the Only accusation as aga-lnst the petitioners is that they were alleged to have entered into an Agreement Of Sale with defaCtO COmPlainant for an extent of land Ac.5.00 cents in Survey No.191 of Namavaram village, Rajanagaram Mandal. The case of Prosecution iS that the signatures of defacto complainant on the said agreement are forged and on coming to know the same, a civ'll suit was filed and the same ¢l.i, s--?9
is pendI'ng before the competent court. Thereafter, the defacto compla[-nant filed the report as against the petitI'OnerS herein. 5. In vI-eWOfthefacts and cI-rCumStanCeS Of the case and sI-nee a civ" suit is already pending before the competent court, thI-S Court feels that the prayer of the petitioners for grant of antjcipatory ba" can be considered, however, on conditions. 6.
Accordingly, jn the event of the arrest of the petitI-Oners/accused Nos.1 {o 3 in the above said crI-me, they sha" be released on bail on executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) each with two sureties for the lI'ke Sum to the sa{isfactjon of the arresting police offl'cl'als and also on condjtjon that the petitioners shall make themselves aval'Iable for jnvestjgatjon as and when requI'red and that they sha" not cause any threat, inducement or prom[-se to the prosecution witnesses.
