HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1946 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant and learned AGA for the State and perused the record. The present anticipatory bail application has been filed seeking anticipatory bail in Case Crime No. 0262 of 2025 under Sections 2(B)(1)(11)/3(1) U.P. Gangster Act, P.S.-Wazirganj, Lucknow. Learned counsel for the applicant submits that co-accused persons have been granted anticipatory bail and he seeks parity with bail orders of the co-accused. Learned AGA has submits that applicant cannot claimed parity with the bail orders of the co-accused persons, as in the Gang chart, only one or two cases are shown against the name of co-accused persons, whereas, the applicant is a history-sheeter and has a criminal history of 14 cases. Thus, no case for anticipatory bail is made out. Perused the record so also the criminal history of the applicant as explained in para 21 of the affidavit filed in support of bail application, which shows that applicant is an accused in several cases, including four cases under Section 392 IPC and has also criminal history under 2/3 of U.P. Gangster Act, at P.S.-Madiyawan, District- Lucknow. Considering the applicant's chequered criminal history, this Court is not inclined to enlarge the applicant on anticipatory bail. Accordingly, the anticipatory bail application is dismissed.
