HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 14253 of 2025 Court No. - 2 HON'BLE MRS. SANGEETA CHANDRA, J. HON'BLE AMITABH KUMAR RAI, J. Heard learned counsel for the parties and perused the record. This petition has been filed with the following prayers :- "Issue a writ, order or direction in the nature of certiorari quashing the judgment and order dated 18.12.2024 passed by the Learned Central Administrative Tribunal, Lucknow Bench, Lucknow in Original Application No.332/00166 of 2023 : Raghav Ram vs. Union of India and Others, contained as (Annexure no.1) to the writ petition." It is the case of the petitioners that the opposite party was initially appointed as waterman in the year 1979 on the contingency paid basis in Division office, Gonda. Subsequently he was given temporary status with effect from 29.11.1989. A gradation list was prepared in which his name is at serial no.8. Department of Posts introduced Casual Labourers (Grant of Temporary and Regularization) scheme for casual labourers who are in employment as on 29.11.1989. The condition was that they should be currently employed and should have rendered continuous service for at least three years. By an order dated 05.02.1993 the opposite party was provided a temporary Group D status with effect from 29.11.1992. The opposite party thereafter filed an original application before the Tribunal for quashing the order dated 20.12.2019 passed by the Superintendent of Post offices, Gonda Division, Gonda rejecting his prayer for pension. The CAT Lucknow bench has allowed the Original application by the impugned judgment and order dated 18.12.2024. Hence, this petition has been filed by the petitioners. It has however been clearly adverted that a bunch of such writ petitions has Versus Counsel for Petitioner(s) : Varun Pandey Counsel for Respondent(s) : U.O.I.Thru.Secy.Deptt. Of Posts And Telegraph,Ministry Of Telecommunications, New Delhi And 4 Ors. .....Petitioner(s) Raghav Ram .....Respondent(s) already been decided by this Court, the leading case of which was Writ A No.11709 of 2024 (Union of India vs. Nebu Lal : Neutral Citation No – 2024 : AHC – LKO : 84232 – DB) and this Court has held that the Tribunal was right in giving the claims, the pensionary benefits, in view of the previous judgments which have already been decided in favour of such employees. This writ petition is also dismissed taking into account a co-ordinate bench decision dated 16.12.2024 as aforesaid. December 10, 2025 mks WRIA No. 14253 of 2025 2 (Amitabh Kumar Rai,J.)
