HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CONTEMPT APPLICATION (CIVIL) No. - 2766 of 2023 Court No. - 8 HON'BLE MANISH KUMAR, J.
1. Learned Standing Counsel has submitted that the compliance affidavit has been filed by Respondent No.3 Shri Puneet Kumar Tiwari, Joint Director / Deputy Director (Incharge), Government Printing Press, Aishbabh, Lucknow on 28.02.2025 and in Paras 7 and 8 a specific averment has been made that the applicant namely Sri Ved Prakash , Sri Chandrika Prasad and Sri Surendra Kumar Sonkar (applicant) were already getting more than 1200-1800 i.e. 1200-2040 ( revised 52,00- 20,200 + 2400) pay scale prior to 31.07.1996. In such a situation no difference was found in the pay-scale of the above three employees including the present applicant, whereas the other petitioners in the writ petition, namely, Sri Ashok Kumar, Mohammad Shakeel Ahmed and Sri Om Prakash Awasthi have been paid the arrears on 10.08.2023 as directed by the writ court, hence the order passed by the writ court has been complied with.
2. On the other hand learned counsel for the applicant has submitted that the applicant was entitled for the higher pay scale and giving him the payscale of Rs.1200 -1800 amounts to reversion, so the judgement and
order passed by the writ court has not been complied with.
3. After hearing learned counsel for the parties and going through the record of the case, the submission made by the learned counsel for the applicant that by giving him the pay scale of Rs. 1200-1800 amounts to reversion as he was getting the higher pay scale. The said submission of
learned counsel for the applicant does not find force for the reason that in the second para of the judgement and order dated 19.01.2023 the prayer made by the petitioners including the applicant has been mentioned, which is quoted hereinbelow: Versus Counsel for Applicant(s) : Laxmi Kant Pathak, Jyotindra Prakash Pathak Counsel for Opposite Party(s) :
Surendra Kumar Sonkar .....Applicant(s) Sri Abhishek Prakesh, I.A.S., Director, Printing And Stationary, U.P. Allahabad And Another .....Opposite Party(s)
"The present petition has been filed praying for quashing of the order dated 18.7.2019 passed by the respondent no. 1, copy of which is annexures 1 to the writ petition whereby the benefit of designation of the post of Machine Assistant (Off Set) and pay scale of Rs. 1200-1800/- has been denied to the petitioners w.e.f 31.07.1996. A further prayer is for consideration of the case of the petitioner in the light of the judgment and order dated 21.03.2005 passed in Writ Petition No. 2790 (SS) of 1998 In re; Kapoor Chand and Ors Vs. State of U.P and Ors, a copy of which is annexure 10 to the writ petition."
4. From perusal of the said para it is found that the applicant alongwith other petitioners had filed writ petition for quashing of the order dated 18.07.2019 whereby the benefit of designation of the post of Machine Assistant (Off Set) and pay scale of Rs. 1200-1800/- has been denied to the petitioners including the present applicant w.e.f 31.07.1996, so the relief made by the petitioner / petitioners is given to them as seen from perusal of para 7 and 8 of the compliance affidavit filed on 28.02.2025. The demand was for giving them the pay scale of Rs. 1200-1800 w.e.f. 31.07.1996, the same has been given to them, hence the judgement and
order passed by the writ court has been complied with and the present contempt application has become infructuous and the same is dismissed as such.
5. Notice, if any, issued against the respondent stands discharged.
6. At this stage, learned counsel for the applicant has submitted that the liberty may be given to the applicant to file a writ petition for redressal of his grievance, if he is still aggrieved.
7. It is always open for the applicant to avail the remedy as may be permissible under the law, for which no separate order is required. December 8, 2025 S. Kumar CAPL No. 2766 of 2023 2 (Manish Kumar,J.) Digitally signed by :- SANTOSH KUMAR High Court of Judicature at Allahabad, Lucknow Bench
