2. The case of the prosecution in nutshell is that the petitioner was found in possession of 2 kgs of ganja. Hence, the police registered the aforementioned crime and arrested him on 09.03.2025. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor. 4. Perused the record. 5.
Ms.B.Praveena, the learned counsel for the petitioner submits that petitioner was falsely implicated by the police in the crime; the alleged contraband involved in this case is 2kgs, which is non-commercial quantity; petitioner is the sole breadwinner; petitioner would abide by any conditions to be imposed by this Court; and urged to allow the petition. 5. Per cot,ira, the learned Assistant Public Prosecutor, opposed in granting of bail stating that previously, the petitioner was involved in similar offence, some more material witnesses have to be examined; investigation is not completed; if the petitioner is enlarged on bail, he would not be available for the investigation and he would escape from the clutches of law; and urged to dismiss the bail petition. 6. As seen from the record, the petitioner has been in the judicial custody for the past 75 days. Keeping in viewofthe period of detention undergone bythe petitionerin judicial custody for more than 75 days, the nature and gravity of allegation levelled against the petitioner, this court is inclined ,to enlarge the petitioner on bail wI'th the following stringent condI-tI'OnS. 8. ln the result, the criminal petition is allowed with the foIIowl-ng conditions: i. The petitioner shall be enlarged on bail subject to his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only), with two sureties each for the like sum to the satisfaction of the learned XVI Additional Metropolitan Magistrate, Bheemunipatnam. ii. The petitioner shall appear before the station House Officer, PM Palem Police Station, Visakhapatnam Commissionerate, on every saturday in between 10:00 am and 05.-00 pm, till cognizance I-S taken by the learned the Trial Court. iii. The petitioner shall not leave the limits of the District without Prior Permission from the learned XVI Additl-onaI Metropolitan MagI-Strafe, Bheemunipatnam iv.
