By filing of the instant writ petition, the petitioner prays for issuance a writ, order or direction in the nature of mandamus thereby commanding to the opposite party no. 2 to transfer the investigation of 0264/2025, Under Section 70(1), 309(4), 352, 351(3) Β.Ν.S., Police Station - Majhgai, District -Kheri to another police station for making free and fair investigation or any other independent agency like C.B.C.I.D. 4. At the very outset, learned A.G.A. states on the basis of instruction sent by Sri Gaurav Singh, Sub Inspector, Police Station- Majhgai, District -Kheri dated 25.9.2025 that final report has already been submitted in the aforesaid case. 5. Upon the same being pointed out, learned counsel for the petitioner states that he does not want to press the instant petition and prays that the same may be dismissed as withdrawn with liberty to file protest petition to the aforesaid final report.
