Heard Shri Vivek Tripathi, learned counsel for the petitioner and Shri Pranjal Mehrotra, learned counsel for the respondents. The petitioner claims to be entitled to be promoted to the post of Divisional Post (Mandal). Shri Pranjal Mehrotra, learned counsel for the respondent contends that the petitioner was transferred from Kanpur to Azamgarh at his own request. Consequent to the aforesaid transfer and as per the relevant rules, the petitioner has been placed at the bottom of the seniority list. He is not entitled to promotion. In wake of the preceding discussion the respondent authorities are directed execute the following directions: I. The respondent authorities shall prepare a seniority list and decide the claim of the petitioner regarding his eligibility for promotion to the post of Divisional Post (Mandal). II. Prior to preparing the seniority list objections shall be called from the concerned employees. III. The exercise shall be completed within a period of six months from the date of receipt of a certified copy of this order. With the aforesaid directions the writ petition is disposed of.
