This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Ramakrishna Akurathi, Advocate for the Petitioner and the Public Prosecutor (AP) on behalf of the Respondent. The Court made the following:

ORDER:- The Criminal Petition has been filed under Section 438 of the Cr.P.C, (Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023) by the petitioner/Accused No.1 for granting of pre-arrest bail in connection with Crime No.32 of 2025 of Rampachodavaram Police Station, Alluri Sitharama Raju District, registered for the offences punishable under Section 420 IPC.
2 (CGR,J Crl.P.No.5602 of 2025) It is alleged in the complaint that the petitioner promised employment upon payment of certain amounts and had collected money from various individuals.
2. Heard
learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State. Perused the record.
3. The learned counsel for the petitioner submits that the police harassed the petitioner to repay the money to the unknown persons. In this context, the petitioner and others filed W.P.No.8032 of 2025, asserting that the police harassed the petitioners to repay the alleged amounts to unidentified parties. This Court, vide
order dated 28.03.2025, disposed of the writ petition with a direction to the police not to disturb the peace of the petitioner without following the due process of law. However, it is submitted that, on the very same day, the police, Rampachodavaram Police Station, registered a case in Crime No.32 of 2025 against the petitioner.
4. The learned counsel further submits that petitioner has been falsely implicated in the said case, despite never having received any money from third parties and seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

6. Considering the submissions of the
learned counsel for the petitioner, the Station House Officer, Rampachodavaram Police Station, Alluri Seetaramaraju District, is
directed to follow the procedure as contemplated under Section 35 (3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, scrupulously, as per the guidelines enunciated in Arnesh Kumar Vs. State of Bihar and another^ (2014) 8 see 273
3 (CGR,J Crl.P.No.5602 of 2025) insofar as the petitioner herein is concerned, for the purpose of investigation in connection with Crime No.32 of 2025. With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
