NC: 2025:KHC:12585-DB CCC No. 273 of 2025
FOR IMPRISONMENT IN THE INTEREST OF JUSTICE AND EQUITY AND ETC.,
THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, JUDGMENT WAS DELIVERED THEREIN AS UNDER:
CORAM: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA and HON'BLE MR JUSTICE K. V. ARAVIND ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA)
Learned Single Judge while disposing of the writ petition on 29.11.2024 observed that the petitioner had made representation dated 09.09.2019 and that respondent No.5 had issued endorsement dated 18.02.2020 in that regard. Learned Single Judge thereafter, permitted the petitioner to file one more representation along with all the relevant documents relating to land acquisition to enable the respondents to take decision in the matter. With such observations the petition came to be disposed of. A contempt of court is alleged in respect of the above direction. 2. On plain reading of the directions, it could be seen that learned Single Judge has not specified any time line for respondent No.5 to act upon the representation. - 3 -

3. In the circumstances it cannot be said that any contempt is committed, much less a willful contempt by any of the respondents at this stage. 4.
Even in the representation 15.01.2025, whereby the petitioner wanted the competent authority to comply with the directions, no time limit is set out by the petitioner. 5. In the aforesaid view, the contempt petition is not entertainable. It is dismissed with an observation that the competent authority shall act in compliance of the directions of learned Single Judge to take a decision in the matter within eight weeks from today.
