HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7210 of 2024 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. This is second bail application of the accused-applicant seeking bail in FIR/Case Crime No.2 of 2024 under section 302, 201 IPC, P.S. Khairabad, District Sitapur. The first bail application of the accused applicant was dismissed as not pressed with the liberty to file a fresh. 3. In terms of the FIR, it was alleged that the daughter of the informant used to work at Lucknow and was in relation with the applicant. Subsequently, her body was found and an apprehension was expressed that he had killed her. The post-mortem report on record indicates ante-mortem hanging, and apart from the ligature mark, four contusions and abrasions were observed on the legs and the scalp region. 4. Considering the post-mortem report and the cause of death as ante- mortem hanging, the material to link the applicant for the offense under section 302 appears to be weak; as such, the applicant, who has no criminal history and is in custody since 03.01.2024 is entitled to bail. Thus the bail application is allowed. 5. Let the applicant Ankit Raj be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned with the following conditions: Versus Counsel for Applicant(s) : Raghunath Singh, S.C.
