HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 2076 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. The present anticipatory bail application has been filed seeking anticipatory bail in Case Crime/F.I.R. No. 0304/2025, U/ Sec-109, 115 (2), 352 & 351 (3) of BNS of 2023, Police Station-Khairighat, District- Bahraich. Heard learned counsel for the applicant and learned A.G.A. for the State. Submission of learned counsel for the applicant is that the present matter arises out of an altercation between the parties, in respect of which cross FIRs have been lodged by both sides. It is contended that three persons from the applicant’s side have sustained injuries, whereas two persons from the complainant’s side have also received injuries, which clearly indicates a free fight. On this basis, it is argued that the applicant has been falsely implicated due to animosity between the parties. Learned counsel further submits that in the event the applicant is granted anticipatory bail, he undertakes to abide by all the terms and conditions that may be imposed by the Court. It is assured that the applicant shall extend full cooperation in the investigation and shall not, in any manner, misuse the liberty granted to him. Perused the record. Versus Counsel for Applicant(s) : Ajey Singh Counsel for Opposite Party(s) : G.A. Manntun @ Mannatul .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another .....Opposite Party(s) A perusal of the injury report reveals that injured Haqeem sustained injury no. 1 on the head, which is a vital part of the body. Likeise, injured Shaukat suffered injury no. 1 on the temporal bone, which is also a vital part. The injured witnesses have supported the prosecution version of the incident. In addition, the independent witnesses, namely Khaleel and Subedar, have corroborated the prosecution case. The occurrence of the incident itself is not in dispute, and it is also admitted that FIRs have been lodged by both sides. In view of the nature of the injuries, the consistent version of the injured and independent witnesses, and the overall material available on record, this Court is not inclined to accept the contention that the applicant has been falsely implicated. Consequently, no case for grant of anticipatory bail is made out. Accordingly, the anticipatory bail application is dismissed. December 19, 2025 R.C.
