HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 4866 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The accused-applicant seeks bail in ST No.527 of 2026 arising out of FIR/Case Crime No.512 of 2015 under sections 147, 148, 149, 302, 307, 308, 452, 506, 120-B IPC and Section 7 Criminal Law Amendment Act, P.S. Kotwali Nagar, District Pratapgarh. 3. It is argued by the counsel for the applicant that the applicant is in custody since 14.07.20214 and the co-accused have been enlarged on bail, the bail orders are on record as Annexure no.5 onwards. It is argued that out of the total thirty six cases, twelve cases were lodged after the applicant was apprehended in the present case and in some of other cases, he has completed the sentence. 4. The contention of the learned AGA is that the role of the applicant is distinct from the co-accused who have been enlarged on bail. 5. The office report sent by the trial court indicates that only one witness has been examined and the right to cross examination was closed. 6. Considering the pretrial detention of more than eleven years undergone by the applicant coupled with the fact that there is no likelihood of the trial being concluded in the near future, clearly the right enshrined under Versus Counsel for Applicant(s) : Durgesh Mishra, Abhishek Shukla, Manvendra Mishra, Saumya Singh Counsel for Opposite Party(s) : G.A. Vikas Singh .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s) Article 21 of the Constitution of India of the applicant are violated. Thus, on that ground alone, the applicant is entitled for the bail. The bail application is allowed. 7. Let the applicant Vikas Singh be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
