Learned counsel for the applicant submitted that while setting aside the order passed by learned Commissioner, no direction was issued remanding the matter back, therefore, the right of applicant will suffer irreparable loss and injury. 3. On perusal of impugned order, it is apparent on the face of it that the revisional court as well as board of revenue have not considered that without hearing the petition on sunday, the case has been decided ex- parte. 4. In view of above, the review application is allowed. 5. The judgment and order dated 12.11.2025 is modified to the extent that the matter is remanded back to the learned Commissioner to hear and decide the matter afresh after providing opportunity of hearing to the parties and record finding on the point that how the matter was decided on Sunday.
