Also heard the learned Additional Public Prosecutor. This petition under Section 482 BNSS is filed by the petitioner, namely, Pranjal Borah, apprehending arrest in connection with Kalaigaon P.S. Case No. 49/2025 registered u/s 69/89/351(2)/351(3) of BNS, 2023. The case arose out of an ejahar dated 03.09.2025 lodged by the alleged Page No.# 2/2 victim. It is revealed that the parties had a relationship in the context of love affair leading to her pregnancy which was aborted on 30.06.2025. Learned Additional Public prosecutor objects to granting of bail to the petitioner. Case diary, as called for, has been received. On perusal of the same, it appears that the petitioner and the alleged victim, who is major, is having a love affair and physical relationship and in course of which certain disputes arose between them. However, pursuant to the interim protection granted by this Court, the petitioner has appeared before the I.O. and his statement has already been recorded. Considering all aspects, this Court is of the view that further custodial interrogation of the petitioner may not be necessary in the facts and circumstances of the case with regard to the nature of the allegation. Accordingly, the prayer for pre-arrest bail is allowed. Interim order passed earlier on 19.09.2025 is hereby made absolute in the same terms and conditions. The anticipatory bail application is accordingly disposed of. JUDGE Comparing Assistant
