The plaintiff filed a suit for recovery of possession. After service of summons, defendants appeared through counsel and filed the written statement. On the basis of the pleadings of the parties, the trial court has framed additional issue No.1 in respect of maintainability of the suit and also re-cast issue No.6 which is also on maintainability. The matter was posted for hearing the additional issue No.1 and re-cast issue No.6 as a preliminary issue. Thereafter the trial court directed that the preliminary issue can also be considered along with the other issues. 3. The only grievance of the petitioner is that since the court has already posted the matter for consideration of preliminary issue, the matter can be decided first as a preliminary issue. 4.
