HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10328 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J. HON'BLE PRASHANT KUMAR, J. 1. Heard learned counsel for the parties. 2. In compliance of order dated November 6, 2025, respondent No.2 is present before this Court. 3. Upon perusal of the record, it appears that one time settlement was entered into by the petitioner with the Bank on August 30, 2024 wherein an amount of Rs.10,00,000/- was to be paid affront and Rs.3,00,000/- was to be paid within a period of 90 days. 4. Learned counsel appearing on behalf of the Bank has submitted that though the petitioner paid Rs.10,00,000/-, Rs.3,00,000/- that was to be paid within a period of 90 days was never paid by the petitioner. In light of the same, the Bank has not released the documents and not issued 'No Dues Certificate' for both the bank accounts on which one time settlement has been reached between the parties. 5. In view of above, we do not find any wrong having been committed by the Bank as the Bank has followed One Time Settlement (OTS) scheme and the petitioner has failed to comply with the obligations under the OTS scheme. Accordingly, the writ petition is dismissed.
