By way of this petition, the petitioner has sought the following relief(s):- “10.1 That, the Hon'ble Court may kindly be pleased to set aside the impugned order dated order dated 29/02/2024 passed by 1 Additional District Judge Ambikapur District Surguja (C.G) arising out of order dated 21/04/2023 passed by Civil Judge Class-II Rajpur in Civil Suit no. 1A/2022 and allow the application under Order 39 Rule 1 and 2 of C.P.C of the plaintiffs/ petitioners, in the interest of justice. 10.2 Any other relief (s) that this Hon'ble Court may deem fit to grant in the facts and circumstances of this SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2025.01.31 17:12:23 +0530 2 case.” 2. Learned counsel for the petitioner would submit that the Civil Suit is fixed for plaintiffs’ evidence before the learned trial Court. He would further submit that the learned trial Court may be directed to conclude the proceedings of Civil Suit No. 1A/2022 pending before Civil Judge Class II, Rajpur, District Balrampur-Ramanujganj within stipulated time. 3. Learned counsel for State submits that in view of limited prayer made by counsel for petitioner, he is having no objection. 4. Taking into consideration the fact that the Civil Suit is pending since 04.01.2023; therefore, the learned trial Court i.e. Civil Judge Class II, Rajpur, District Balrampur-Ramanujganj is directed to conclude the proceedings of the Civil Suit No. 1A/2022 expeditiously. 5.
