This appeal is directed against order dated 24.01.2023 passed by learned Single Judge in Writ - A No. 28945 of 2021, whereby the writ petition filed by the respondent was allowed and the order dated 24.07.2021 granting provisional pension was set aside and the appellants were directed to pay retiral benefits and final pension to the respondent forthwith within a period of two months from the date of production of the certified copy of the order. 2. Learned counsel for the appellants, based on instructions, which are taken on record, submits that during the pendency of the present appeal, the respondent has died on 03.08.2023 before conclusion of the criminal proceedings and therefore, the criminal proceedings have abated, based on which the wife of the respondent has been paid all the pensionary benefits and therefore, the present appeal has been rendered infructuous. 3.
